Jury deliberates in Eric Kirkpatrick’s case

VANCOUVER (NEWS1130) – The fate of a man who fatally shot his former boss at a company Christmas party two years ago is now in the hands of a jury.
The jurors will have to decide if Eric Kirkpatrick planned to murder his former boss Ben Banky in December of 2008. Kirkpatrick says he wanted revenge after being fired the day before, but never intended to kill anyone. He shot his former boss three times.
Kirkpatrick pleaded not guilty to first degree murder, saying he went to the TallGrass Distribution party with the intention of telling his side of the story.
His lawyer says his client was not thinking clearly because of medication for epilepsy and was upset about the death of his wife. If the jury doesn’t believe Kirkpatrick planned the shooting, he could be acquitted or found guilty of second degree murder.
