Suspended sentence for senior who killed flagperson

NEW WESTMINSTER (NEWS1130) – An elderly man who hit and killed a traffic flagger while banned from driving has been handed a suspended sentence.

A supreme court judge gave 88-year-old Melle Pool two years of probation and a 10-year driving ban. The victim’s colleagues are outraged over the sentencing.

“Terry Mitchell’s wife has not only lost her husband, but she’s got no justice,” says Diane Herback with the BC Traffic Flaggers Association.

The wife of Terry Mitchell, 52, burst into tears at the sentencing. Her husband was killed while working near Fort Langley in 2008.

Poole was banned from driving 10 years ago because he has macular degeneration. “That old guy, knew he shouldn’t be doing it, but he kept doing it anyway,” says Herback.
