Lawyer for teenager involved in child porn wants case dismissed

VICTORIA (NEWS1130) – The lawyer for a Victoria girl found culpable on child pornography charges for “sexting” wants a judge to dismiss the case. The use of this charge against a teenager is unconstitutional.
The girl sent nude photos of another underage girl to two people – she was found responsible about a year ago. Her lawyer Christopher Mackie says Crown counsel is overreaching. “Those laws were designed to deal with pedophiles and they bare no relation to this teenaged phenomenon of sexting. So we’re saying it’s utterly inappropriate, ultimately unlawful.”
No precedent would be set even if the judge in this lower court rules in his client’s favour. But, Mackie adds, it could go to the Supreme Court of Canada if his client consents.
