Man convicted of killing his boss appeals case

VANCOUVER (NEWS1130) – The man sent to prison for killing his ex-boss at a Vancouver Christmas party is appealing his case.
A panel of three judges from the BC Court of Appeal has reserved its decision in an attempt by Eric Kirkpatrick to overturn his conviction.
He was found guilty by a jury in 2010 of second degree murder in the fatal shooting of Ben Banky during a Christmas party in 2008. Kirkpatrick was given life in prison with no chance of parole for 15 years.
Banky was the co-owner of TallGrass Distribution, and Kirkpatrick had been fired the day before.
The jury heard that Kirkpatrick showed up at the Christmas party with a shotgun.
His lawyer had suggested there were some mental health issues involved and argues in his appeal that the judge did not put enough emphasis on a doctor’s observations.
There is no timeline for the appeal court ruling.
